Monsanto Wants PCB Case Moved Under CERCLA

Law360 (July 9, 2007, 12:00 AM EDT) -- Monsanto Chemical Co. aims to return a state case, which alleges that the company’s paint contained a hazardous substance that contaminated a creek and diminished the value of nearby properties, to federal court.

Monsanto made the bid Friday to move the purported class action from Montana state court back to the U.S. District Court for the District of Montana, claiming that two new counterclaims against it were raised under federal law and authorized the removal of the entire case.
