PharmaStem Blood Storage Patents Not Valid: Judge

Law360 (July 9, 2007, 12:00 AM EDT) -- In an upset for PharmaStem Therapeutics, a federal appeals court has determined that Boston-based biotechnology company ViaCell Inc. and other defendants did not infringe PharmaStem’s technology for the collection and storage of umbilical cord blood.

On Monday, the U.S. Court of Appeals for the Federal Circuit affirmed a lower court’s decision that ViaCell’s marketing of ViaCord did not violate PharmaStem’s two patents, and reversed its decision that PharmaStem’s two patents were valid, finding instead that they were based on prior art.
