Kia Can't Duck $5.6M Faulty Brake Damages: Pa. High Court

Law360, New York (December 5, 2011, 7:54 PM EST) -- Kia Motors America Inc. on Friday lost a bid to overturn a $5.6 million judgment against it in a class action over allegedly faulty brake systems when Pennsylvania's Supreme Court affirmed the lower court's class certification and damages award.

The high court did reverse one aspect of the trial court's $4.1 million attorney fee award that approved using a risk multiplier on top of the lodestar — the product of reasonable fees times reasonable hours — and remanded that issue to the lower court to adjust...
