In Landmark Ruling, Court Orders EC To Pay Damages

Law360, New York (July 11, 2007, 12:00 AM EDT) -- The European Court of First Instance has ordered the European Commission to compensate French utility Schneider Electric for wrongfully blocking the company's proposed merger with fellow power company Legrand, marking the first time the regulator has been forced to pay damages.

The Court ruled Wednesday that “the grave and manifest failure by the Commission to have regard to Schneider's rights of defense constitutes a sufficiently serious breach of Community law to confer such a right.”
