Insurers Must Back Massey Against Injury, Damage Claims

Law360, New York (December 6, 2011, 9:55 PM EST) -- A West Virginia judge on Monday ruled that a group of insurers are required to defend Massey Energy Co. in an underlying suit alleging its coal mining operations caused bodily harm and property damage to private individuals.

Judge William Thompson denied the insurers' bid for summary judgment, rejecting their arguments that Massey was not entitled to coverage under a "seepage, pollution and contamination" exclusion in the policy at issue.
