Fed. Circ. Upholds Sara Lee Win In Bread Patent Fight

Law360, New York (December 9, 2011, 9:46 PM EST) -- The Federal Circuit on Friday backed a ruling holding that the Earthgrains Co., now known as Sara Lee Bakery Group Inc., did not infringe a chemist’s patented bread ingredient and that any damages in the case must be limited by the date in which the patent was reissued.

A three-judge panel denied Yoon Ja Kim’s appeal of two separate Illinois federal court rulings against the food chemist in her infringement case over her patented potassium bromate replacer baking component.
