Bayer Rips Dow’s Defense In Plant Genetics Patent Row

Law360, New York (December 13, 2011, 5:21 PM EST) -- Bayer CropScience AG on Monday attacked Dow AgroSciences LLC's argument that it had not infringed a Bayer patent for a genetic process that makes plants herbicide-resistant, calling Dow’s defense a question of “semantics.”

Dow had told a Delaware federal court that the enzyme it uses to break down weed killer toxins is classified under a different name and therefore doesn't infringe Bayer's patent.
