DC Circ. Sides With FERC In Wholesale Power Pricing Row

Law360, New York (December 13, 2011, 9:34 PM EST) -- The D.C. Circuit on Tuesday declined to review a Federal Energy Regulatory Commission decision rejecting the Alabama Municipal Electric Authority’s claims that transmission provider Southern Co. Services Inc. was overcharging it for wholesale power.

A three-judge panel ruled FERC had correctly found that Southern did not need to charge AMEA rates for unbundled transmission service on par with those for power transmission services for retail customers, which are lower.
