Kroes Poised To Drop Abertis Case

Law360, New York (July 16, 2007, 12:00 AM EDT) -- A European Commission infringement proceeding against Italy over the member state's move to block a merger between two toll-road operators may be over before it begins, as the Commission is expected to drop the case on Wednesday, according to several reports.

Competition Commissioner Neelie Kroes is expected to toss the proceeding on the condition that the Italian government remove the obstacles that it put in place to prevent the merger of Italian motorway operator Atlantia SpA, formerly known as Autostrade, and Spanish company Abertis Infraestructuras SA...
