Worker's Migraines Can't Carry ADA Claims: 10th Circ.

Law360, New York (December 21, 2011, 4:12 PM EST) -- The Tenth Circuit on Wednesday refused to revive a former medical assistant’s wrongful termination suit, finding that her migraines were not debilitating enough to fall under the Americans With Disabilities Act’s definition of a disability. 

The appeals court affirmed an Oklahoma federal court’s decision to award summary judgment to the SouthCrest Hospital over Alethia Roselle Allen’s claims that the hospital failed to accommodate her disability and wrongfully terminated her employment.
