8th Circ. Says Ex-Grainger Worker Can't Prove Race Bias

Law360, New York (December 22, 2011, 6:29 PM EST) -- The Eighth Circuit on Thursday refused to revive a discrimination and breach of employment contract suit against industrial supply company W.W. Grainger Inc., finding that a Hispanic branch manager had not adequately shown his termination was racially motivated.

In a published, unanimous opinion, the appeals court affirmed a Minnesota federal court’s decision to award Grainger summary judgment on Arturo E. Martinez’s discrimination, wrongful termination and breach of contract suit.
