Sierra Club Sues DOE Over Planned Mich. Ethanol Plant

Law360, New York (December 23, 2011, 5:33 PM EST) -- The Sierra Club sued the U.S. Department of Energy on Thursday for allegedly failing to adequately perform environmental review procedures in its approval and funding of a proposed ethanol plant in the Upper Peninsula of Michigan.

The lawsuit alleges the Energy Department violated the National Environmental Policy Act in its environmental assessment of the plant, to be located in Kinross Charter Township, Mich. It also says the department failed to complete a proper environmental impact statement.
