Doctors Seek High Court Reversal Of DNA Patentability

Law360, New York (December 23, 2011, 10:11 PM EST) -- A group of medical associations recently asked the U.S. Supreme Court to decide whether human genes are patentable in a challenge to a watershed Federal Circuit ruling earlier this year that backed up the validity of patents related to two breast cancer genes developed by Myriad Genetics Inc.

The medical groups are asking the high court to reverse the appellate court's June determination that the DNA molecules isolated by Myriad had been sufficiently altered from their natural state to merit patentability.
