FirstEnergy Hit With CERCLA Suit Over 2 Fla. Sites

Law360, New York (January 3, 2012, 3:29 PM EST) -- A Progress Energy unit sued FirstEnergy Corp. on Tuesday for cleanup costs at two former manufactured gas plants in central Florida, pointing to a FirstEnergy predecessor whose directors allegedly plundered funds from the plaintiff's own predecessors.

Florida Power Corp., which does business as Progress Energy Florida Inc., is seeking contributions from FirstEnergy under the Comprehensive Environmental Response, Compensation and Liability Act for more than $1.8 million it has incurred at sites in Orlando and Sanford, Fla., responding to contamination.
