ITC Denies Sanctions Bid In NuvaRing Patent Row

Law360, New York (January 4, 2012, 6:33 PM EST) -- A U.S. International Trade Commission judge on Tuesday ordered Femina Pharma Inc. to make its CEO available for deposition but refused a sanctions bid by NuvaRing maker Merck & Co. Inc. in a fight over whether the birth control device violates a Femina patent.

Administrative Law Judge Thomas P. Pender denied the motion for nonmonetary sanctions filed by Merck and subsidiaries Schering Plough Corp., Organon USA Inc. and NV Organon, finding Merck had failed to justify the sanctions under the ITC's rules.
