Employers Brace For NLRB's 'Ambush Election' Rule

Law360, New York (January 27, 2012, 3:05 PM EST) -- The National Labor Relation's Board's controversial regulation aiming to streamline the union election process is not slated to go into effect for three months, but attorneys say employers should take steps now to ready themselves for the so-called “ambush election” rule.

The new rule, finalized in December, seeks to cut down on delays by limiting the pre-election hearing that follows the filing of an election petition to determining “if a question of representation exists.”
