Supreme Court's Title VII Tests Outdated: 7th Circ.

Law360, Los Angeles (January 6, 2012, 9:22 PM EST) -- The Seventh Circuit on Friday slammed the two-track method for evaluating Title VII claims created nearly 40 years ago by the U.S. Supreme Court, issuing a critical opinion in their decision reinstating a fired postal worker’s race discrimination and retaliation claims.

A three-judge panel agreed Friday that a district court’s grant of summary judgment against Denise Coleman in her fight with the U.S. Postal Service should be overturned, but said the case drew attention to the “snarls and knots … inflicted on courts and litigants alike”...
