Psystar Takes Mac OS X Copyright Feud To High Court

Law360, New York (January 6, 2012, 8:07 PM EST) -- Psystar Corp. urged the U.S. Supreme Court late last month to review the Ninth Circuit's rejection of its copyright misuse argument that Apple Inc.’s licensing agreement requiring its Mac OS X operating system to run only on Apple computers was unenforceable.

In a writ of certiorari petition filed Dec. 27, Psystar asks the high court to determine whether it is copyright misuse to use a copyright in operating-system software to limit the use of the operating system to computers manufactured by the copyright owner.
