Clarifying 'Bodily Injury' In Abuse Cases

Law360, New York (January 12, 2012, 12:31 PM EST) -- In August of 2011, the Oblates of St. Francis de Sales Inc. and its insurers settled 41 cases relating to allegations of childhood sexual abuse, for approximately $24.8 million dollars.

In related insurance coverage litigation between the Oblates and United States Fire Insurance Co. in the Delaware Superior Court, which arose from a 2008 settlement by the Oblates with another abuse claimant, the Superior Court was asked to consider the insurance policies’ definition of “bodily injury” in the context of a clergy sexual abuse claim....
