Warrantless Va. Mine Safety Searches Were Legal: 4th Circ.

Law360, New York (January 13, 2012, 6:25 PM EST) -- The Fourth Circuit on Friday upheld a lower court ruling that mining company LeSueur-Richmond Slate Corp. did not have its Fourth Amendment rights violated when Virginia state government officials conducted warrantless searches of its mining facility.

The searches, which were conducted by mineral inspectors for the Virginia Department of Mines, Minerals and Energy after receiving tips that the mine was not in compliance with Virginia regulations, produced 32 citations for safety hazards, according to the unanimous, published opinion.
