Medtronic, Attys. Drain Defibrillator Plaintiff Pool

Law360 (July 19, 2007, 12:00 AM EDT) -- Both sides' attorneys in the court battle over Medtronic Inc.'s defibrillators want a slew of plaintiffs tossed from the consolidated case and filed 15 joint stipulations for dismissal Thursday.

Plaintiffs' attorney Doug Schmidt said Thursday that the plaintiffs in question “just didn't fit” into the consolidated Minnesota district court case, given their claims.

Medtronic spokesman Rob Clark called those plaintiffs' claims meritless. He noted that the plaintiffs that both sides are seeking to dismiss had used debrillators other than the ones covered by the multidistrict litigation,...
