Judge Denies Dismissal of SCO Copyright Suit Vs. IBM

Law360, New York (February 11, 2005, 12:00 AM EST) -- A federal judge in Utah has rejected IBM’s motions to dismiss a major portion of a closely watched copyright infringement lawsuit brought by SCO Group over the alleged insertion of proprietary Unix code into the freely distributed Linux operating system.

U.S. District Judge Dale A. Kimball of the U.S. District Court for the District of Utah denied one SCO motion and four IBM motions or cross-motions.
