Duke Settles Enviros' Challenge To NC Plant Permit

Law360, New York (January 18, 2012, 3:02 PM EST) -- Environmental groups on Tuesday settled their dispute with Duke Energy Corp. over additions to a North Carolina coal-fired power plant, with the company agreeing to make previously planned plant retirements legally enforceable.

Under the agreement, Duke Energy Carolinas LLC will retire 1,667 megawatts worth of coal-fired units, and in exchange, the Environmental Defense Fund, Sierra Club and three other groups will drop their petitions before a North Carolina administrative board challenging a permit for Duke's Cliffside, N.C., plant.
