Union Pacific, Anschutz Dodge Mine Cleanup Suit For Now

Law360, New York (January 19, 2012, 6:10 PM EST) -- A Missouri federal judge on Thursday dismissed Asarco LLC's suit against Anschutz Mining Corp. and Union Pacific Railroad Co. seeking contributions toward an $80 million cleanup at a mining site that Asarco fully covered, though the company will be able to try again.

U.S. District Judge John A. Ross said Asarco had failed to allege that the other two companies were responsible for contributing to hazardous waste at the southeastern Missouri mining site, whose cleanup Asarco funded as part of its bankruptcy reorganization.
