Genova Targets Kansas Lab Over Autism Test Patent Deal

Law360, New York (January 19, 2012, 9:39 PM EST) -- Genova Diagnostics Inc. sued Great Plains Laboratory Inc. in North Carolina federal court Thursday, alleging Great Plains violated a 2005 court settlement between the companies when it allowed another lab royalty-free use of a patented autism test but collected licensing fees from Genova.

The suit claims Great Plains violated a settlement agreement ending a patent infringement suit it had originally filed against Genova in 2004. Great Plains settled with Genova in 2005, agreeing to grant it a patent license under terms no less favorable than given...
