Patently Unfair

Law360, New York (February 6, 2012, 12:59 PM EST) -- In theory, the United States patent system is designed to promote innovation. In practice however, the system, as it has evolved, is having the opposite effect. The dramatic increase in patent litigation effectively stifles innovation by making it extremely difficult for companies, especially in the technology industry, to prosper and compete on a level playing field.

From 2004 to 2009, patent infringement lawsuits jumped a reported 70 percent. Even more disturbing, license fee requests reportedly jumped 650 percent for the same time period. Unfortunately, at least...
