India To Unveil Guidelines For Biotech Patents

Law360, New York (February 17, 2005, 12:00 AM EST) -- India’s government is preparing guidelines to deal with patenting of gene sequences, according to local news reports.

Under the proposed guidelines, gene sequences can be patented only if the claim satisfies three broadly defined criteria to ensure the patented biological material was not originally part of nature, according to the Economic Times of India.

First, the technology should involve an inventive step; second, it must be non-obvious to a person skilled in the art; and third, it should be capable of industrial application, the business daily...
