Bayer Sues Dow Over Herbicide-Resistant Plant Patents

Law360, New York (January 26, 2012, 1:49 PM EST) -- Bayer CropScience AG slapped Dow AgroSciences LLC with a lawsuit in Virginia federal court last week, claiming that Dow infringed four patents covering technology for genetically modifying plants to make them herbicide and antibiotic resistant.

In a complaint filed Jan. 20, Bayer alleges that Dow had a nonexclusive license to the patents under a 1992 deal between Hoechst Aktiengesellschaft, which is now Bayer, and Lubrizol Genetics Inc., which is now Dow, but that the agreement has been terminated, so Dow is no longer authorized to use...
