Muscle Pharm Infringed Creatine Formula: Suit

Law360, New York (February 2, 2012, 7:08 PM EST) -- Dietary supplement maker ThermoLife International LLC sued rival Muscle Pharm Corp. in Arizona federal court Wednesday, alleging Muscle Pharm has infringed its formula for the bodybuilding supplement creatine nitrate.

The complaint alleges that Muscle Pharm is violating ThermoLife's U.S. Patent Number 7,777,074, which covers amino acid compounds including creatine nitrate.

ThermoLife claims it purchased Muscle Pharm’s “Creatine” supplement from a GNC store in Chandler, Ariz., and that the product's label indicated that the supplement included ThermoLife’s patented creatine nitrate.
