Supermarket Group Protests Medco, Express Scripts Deal

Law360, New York (February 6, 2012, 6:40 PM EST) -- The Food Marketing Institute on Monday joined the chorus of voices protesting the proposed merger of pharmacy benefits managers Express Scripts and Medco Health Solutions Inc., arguing it will be a devastating blow to supermarket pharmacies nationwide.

FMI, a trade group which represents some of the nation’s largest supermarkets, asserted the merger will hurt supermarket pharmacies by substantially reducing reimbursement rates and forcing supermarket customers into Express Scripts mail-order pharmacy service, the group said in a letter to Federal Trade Commission Chairman Jonathan Leibowitz.
