Ark. Court Favors Tractor Cos. In Rollover Suit Appeal

Law360, New York (February 6, 2012, 8:38 PM EST) -- Arkansas' highest court on Thursday reversed part of a verdict finding a Japanese tractor maker and its American subsidiary liable for the death of a man whose tractor rolled over, saying the companies lacked control over the incident in different ways.

The Arkansas Supreme Court ruled that a lower court should not have exercised jurisdiction over Yanmar Co. Ltd., the Japanese company, because the company did not have enough contacts in the state and there was not enough proof to show it dominated its subsidiary, Yanmar America...
