No Quick Win For Ex-KV Pharma CEO On Criminal Costs

Law360, New York (February 8, 2012, 10:08 PM EST) -- Delaware law doesn't require KV Pharmaceutical Co. to pay for the criminal defense of its former CEO, who was jailed after the company sent out dangerously oversized pills, but he may still be able to recover the costs under his contract, a judge said Tuesday.

Marc S. Hermelin, the former KV CEO, who pled guilty in March to federal charges of misbranding drugs, sued KV, saying Delaware law entitled him to indemnification in the criminal case and related investigations by the U.S. Food and Drug Administration...
