In Landmark Case, Federal Circuit Finds For Merck

Law360, New York (July 27, 2007, 12:00 AM EDT) -- Following the U.S. Supreme Court's landmark 2005 decision in a case over whether drug makers can ignore their competitors' patents during research on rival treatments, the U.S. Court of Appeals for the Federal Circuit Friday granted victory to German drug maker Merck KGaA.

On remand from the High Court, the circuit court reversed a district court finding that the Merck affiliate had infringed four patents held by Integra LifeSciences Holdings Corp. In 2004, the Federal Circuit had upheld that finding, only to have the Supreme Court...
