Beazer East, Koppers To Face Wood Plant Pollution Claims

Law360, New York (February 10, 2012, 8:05 PM EST) -- A federal judge declined Friday to trim a putative class action alleging Koppers Inc., Beazer East Inc. and McClellan Logging Inc. are liable for pollution from a Gainesville, Fla., wood treatment plant, ruling claims brought by nearby property owners are properly stated under a Florida environmental law.

The suit, first filed in 2010, said McClellan contributed to the pollution when it delivered logs to the treatment facility owned by Koppers and Beazer East, stirring up toxic dust that contaminated nearby residential properties.
