BNSF Railway Settles Wash. CWA Suit For $2.5M

Law360, New York (February 15, 2012, 3:26 PM EST) -- A federal judge in Washington state on Tuesday approved a $2.5 million settlement in Puget Soundkeeper Alliance's suit accusing BNSF Railway Co. of allowing wastewater pollutants to filter into surface waters in violation of the Clean Water Act.

U.S. District Judge John C. Coughenour entered a consent decree in which Berkshire Hathaway Inc. subsidiary BNSF agreed to pay $1.5 million to an environmental charity, The Rose Foundation for Communities and the Environment, and $1 million in fees and costs to plaintiffs counsel Smith & Lowney PLLC....
