K-Cup Suit Against Green Mountain Is Filtered Out

Law360, New York (February 15, 2012, 9:04 PM EST) -- An Arkansas federal judge dismissed a lawsuit brought by online coffee seller Coffee.org Inc. Wednesday that accused Green Mountain Coffee Roasters Inc. of gobbling up distributors of single-serve coffee capsules called K-Cups to form a monopoly, fix prices and muscle out competitors.

Chief U.S. District Judge P.K. Holmes III signed off on a 16-page order dismissing the case with prejudice and saying that “it appears clear that plaintiff can prove no set of facts which would entitle it to relief.”
