Insurer Gets OK To Sue In $6.5M Weed Trimmer Case

Law360, New York (July 31, 2007, 12:00 AM EDT) -- An insurance company has been given the go ahead to sue another insurer on behalf of weed trimmer maker Sufix U.S.A., which forked over $6.5 million in a product liability lawsuit after settlement talks fell apart.

Publishing its decision Monday, the U.S. Court of Appeals for the Sixth Circuit said excess insurance company National Surety Corp. could “step into the shoes” of Sufix to seek redress after the company's primary insurer rejected a $1 million plaintiffs demand before losing the case at trial.
