High Court Won't Weigh In On FLSA Anti-Retaliation Case

Law360, New York (February 21, 2012, 5:57 PM EST) -- The U.S. Supreme Court on Tuesday refused to hear a petition against a ruling that job applicants who say they weren't hired because they had sued past employers for labor law violations could not bring claims under federal anti-retaliation law.

The court offered no comment on its denial of Science Applications International Corp. employee Natalie Dellinger’s petition for a writ of certiorari, which she filed in November seeking to overturn a Fourth Circuit decision barring job applicants from suing potential employers under the Fair Labor Standards...
