Fed. Circ. Affirms Aromont Meat, Veggie Stock Tariff Win

Law360, New York (February 21, 2012, 4:49 PM EST) -- The Federal Circuit on Tuesday upheld food importer Aromont USA Inc.'s successful challenge to the 100 percent duty rates assessed on its meat and vegetable stock products, finding that the imports had been misclassified.

In August 2010, the U.S. Court of International Trade granted Aromont summary judgment, ruling that the U.S. had improperly classified the imported products — made from veal, chicken, duck, lamb, beef, fish, lobster, mushrooms and vegetables — as soup when it should have classified them as “food preparations not otherwise specified.” Under...
