Circuit Denies Extension For Depression Patch Patent

Law360, New York (August 1, 2007, 12:00 AM EDT) -- A circuit court has denied Somerset Pharmaceuticals Inc.’s request to extend the term of a patent covering a patch treatment for depression, after the U.S. Patent and Trademark Office ruled against an extension.

The U.S. Court of Appeals for the Federal Circuit ruled Tuesday against Somerset’s request for an injunction to compel USPTO Director Jon W. Dudas to grant an interim extension for the patent, which is set to expire on Aug. 18.
