Ex-Coke Unit Suffers Setback In Asbestos Coverage Row

Law360, New York (February 23, 2012, 6:28 PM EST) -- A Wisconsin judge on Tuesday tossed breach of contract claims against three insurance companies accused of violating agreements with former Coca-Cola Co. subsidiary Cleaver-Brooks Inc., which has faced more than 200,000 asbestos-related lawsuits since 1985, but the case is still headed to trial.

Milwaukee County Circuit Court Judge Timothy Witkowiak granted AIU Insurance Co., Lexington Insurance Co. and National Union Fire Insurance Co. of Pittsburgh, Pa.'s motion for summary judgment on two claims for permanent injunctions to force the insurers to abide by a 2011 agreement and one breach of contract claim.
