Law360, New York (February 23, 2012, 6:45 PM EST) -- The Sixth Circuit on Thursday shot down an interlocutory appeal by Blue Cross Blue Shield of Michigan in an antitrust suit brought by the U.S. and the state of Michigan seeking to enjoin Blue Cross from the use of most-favored-nation clauses in its contracts with Michigan hospitals.
Citing Huron Valley Hospital Inc. v. City of Pontiac, the appeals court dismissed Blue Cross’ appeal for lack of a final appealable order.
