Monsanto First To Invent Modified Corn Type: Fed. Circ.

Law360, New York (February 28, 2012, 7:24 PM EST) -- The Federal Circuit ruled Tuesday that Monsanto Technology LLC is entitled to seniority in a dispute with Pioneer Hi-Bred International Inc. over which company was the first to invent a type of genetically modified corn.

The appeals court affirmed a 2009 decision by the U.S. Patent and Trademark Office's Board of Patent Appeals and Interferences granting seniority to Monsanto. While Pioneer argued that the board's analysis of the claims was improper, "we disagree that there was any error in this case," the Federal Circuit wrote....
