Kolon Sanctioned In DuPont Body Armor Antitrust Suit

By Scott Flaherty (February 29, 2012, 2:39 PM EST) -- A Virginia federal judge on Tuesday handed down sanctions against Kolon Industries Inc. in its body armor antitrust complaint against DuPont Co., after Kolon failed to produce documents from third-party sales agents despite warnings from the judge.

In his opinion, U.S. District Judge Robert E. Payne took aim at Kolon and Paul Hastings LLP attorney Carla Walworth for telling the court in a Sept. 15 hearing that the company would produce documents from seven outside salespeople, including ex-DuPont employee Michael Mitchell, who previously pled guilty to trade secrets theft and obstruction of justice.
