Jury Orders Safeway Unit To Pay $3.5M In Gift Card IP Row

Law360, New York (February 29, 2012, 7:27 PM EST) -- A Wisconsin federal jury on Wednesday determined that a Safeway Inc. subsidiary's infringement of a patent used in the computerized processing of gift cards merited a damages award of $3.5 million for rivals Interactive Communications International Inc. and its E2Interactive Inc. affiliate.

The jury hit Blackhawk Network Inc. with the verdict after determining that the sum was a reasonable royalty that Safeway's gift card arm would have paid had it properly licensed the InComm patent-in-suit.
