Case Study: Abbott Point Of Care V. Epocal

Law360, New York (March 20, 2012, 12:59 PM EDT) -- The United States Court of Appeals for the Federal Circuit recently resolved a dispute as to proper ownership of two patents pursuant to 35 U.S.C. § 261 where both parties claimed that the patents has been assigned to them, U.S. Patent Nos. 6,845,327 and 6,896,778 (the ’327 and ’778 patents, respectively). The ’327 and ’778 patents cover systems for testing blood samples, and on their face are assigned to defendant-appellee Epocal Inc., which was founded by the inventor, Imants Lauks.
