Perdue Chicken Waste Pollution Fight Heads To Trial

Law360, New York (March 1, 2012, 5:14 PM EST) -- A Maryland federal judge on Thursday refused to hand summary judgment to chicken giant Perdue Farms Inc. or an environmental group claiming a Perdue contractor violated the Clean Water Act by polluting Chesapeake Bay with poultry waste, sending the case to trial.

U.S. District Judge William M. Nickerson said he is limited about what he can decide at this stage in the proceedings, even though the matter is scheduled for a bench trial.
