Hot Wheels Spat Merits Another Lap

Law360, New York (August 3, 2007, 12:00 AM EDT) -- On the same day that Mattel Inc. was hit by recall woes, the U.S. Court of Appeals for the Ninth Circuit gave the toymaker a much-needed boost by tossing out an adverse intellectual property ruling regarding its popular Hot Wheels line of toy vehicles.

On Thursday, the Ninth Circuit reversed and remanded the trademark infringement case after determining that the district court had been wrong to grant summary judgment to plaintiff and Mattel rival, Jada Toys Inc.
