Fed. Circ. Says Apple Reissue App Can Be Broadened

Law360, New York (March 5, 2012, 5:38 PM EST) -- The Federal Circuit handed two inventors a win Monday, reversing a U.S. Patent and Trademark Office board's decision to reject several claims in a broadening reissue application for an Apple Inc. patent related to data transfers within a computer system.

A three-judge panel issued the precedential ruling striking down a Board of Patent Appeals and Interferences decision, which concluded that the inventors' third reissue application sought to impermissibly broaden the patent outside of a two-year time limit provided for in federal law.
