Insurer Ducks $6M Suit Over Coverage For Smashed Plane

Law360, New York (March 6, 2012, 7:48 PM EST) -- A federal judge in Washington state on Monday tossed aircraft manager SMS Services LLC’s $6 million suit claiming insurer HUB International Northwest LLC negligently reduced its coverage without notice just before its plane was destroyed, saying HUB had no duty to notify SMS.

U.S. District Judge Marsha J. Pechman said that because SMS did not consult or seek advice from HUB or have a longstanding or special relationship with the insurer, SMS cannot recover any damages from HUB based on negligence. The judge granted HUB's motion...
